General Terms and Conditions of Use
Introduction
This document sets out the general terms and conditions of use ("Terms") of the Feuille de temps service.
Acceptance of the Terms
Use of the service implies full and unconditional acceptance of these Terms. If you disagree with all or part of the Terms, please contact us before using the service.
Description of the service
The service is online software offering the features defined on the service's website. The service is accessible through a web browser on a computer, tablet, or smartphone. It is optimized for computers as well as tablets and phones.
Changes to the service and the Terms
The service provider reserves the right to modify the service and the Terms at any time. Any change will be posted on this page and will take effect 30 days after its publication. Users are invited to check this page regularly. Continued use of the service after changes are published implies acceptance of the new Terms.
Support
Support for using the service is available in the following ways:
- Online documentation: available 24 hours a day, 7 days a week, at https://feuilledetemps.ca/docs/intro
- Frequently asked questions (FAQ): available 24 hours a day, 7 days a week, at https://feuilledetemps.ca/docs/intro
- Email: Monday to Friday, 9 a.m. to 5 p.m., Atlantic Time, at support@feuilledetemps.ca
We do everything we can to respond to emails as quickly as possible. Email support response times are usually one to two days at most, but we cannot guarantee this timeframe. Events such as vacations or a heavy workload could extend it.
Backups
Our databases are backed up daily by our hosting provider, which also keeps transaction logs: we can restore the database to its state at any point in the last seven days.
A copy is also deposited three times a day with a second Canadian hosting provider, in Beauharnois, Quebec, and kept for 90 days. It is encrypted before it leaves our servers: this hosting provider keeps files it cannot open. It allows us to restore the service even if we were to lose access to our main hosting provider.
These backups are used to bring the service back online after an incident. They do not replace your own exports: your data remains exportable at any time from the application.
Liability
The service is provided "as is" and "as available," without express or implied warranty, including without limitation, warranties of merchantability, fitness for a particular purpose, or accuracy. The provider disclaims all liability for indirect, consequential, special, or incidental damages (including loss of profits, loss of data, or business interruption) arising from the use or inability to use the service. This limitation does not apply in cases of gross negligence, fraud, or bodily injury.
Intellectual property
The content of the service (text, images, videos, etc.) is protected by applicable intellectual property legislation. Users agree not to use this content for commercial or unlawful purposes.
Personal data
We are committed to protecting users' personal data in accordance with applicable legislation.
See our privacy policy to learn more about how your data is processed.
Display of the organization's name and logo
By using Feuille de temps, organizations agree to have their name and logo displayed on the Feuille de temps website's homepage. If you do not wish to appear there, you may let us know at info@feuilledetemps.ca
Termination
Users may terminate their use of the service at any time. The service provider reserves the right to terminate a user's use of the service in the event of non-compliance with the Terms.
Questions
For any questions, you may contact us by email at info@feuilledetemps.ca
Force majeure
The provider will not be held liable for delays or failures to meet its obligations resulting from a case of force majeure, such as a disaster, a major technical failure, a cyberattack, a disruption of communication networks, a strike, an extreme weather event, or any other cause beyond its reasonable control.
Applicable laws
These Terms are governed by the laws of Canada, and more particularly by those of the province of New Brunswick. Any dispute relating to the interpretation or performance of the Terms will be submitted to the competent courts of New Brunswick.
Governing language
In the event of any discrepancy between the French and English versions of these Terms, the French version shall prevail.
