In Manitoba, overtime calculation follows The Employment Standards Code and the Employment Standards Regulation. They set a minimum: your policy or collective agreement can offer more, never less.

When does an hour become overtime?​
Standard hours of work are 8 hours a day and 40 hours a week (section 10). Every hour beyond either threshold is overtime and is paid at least 150% of the employee's regular wage rate (section 17). A break during which the employee is free to leave the premises does not count.
The two thresholds work together. According to the department's examples, first count the hours over 8 on each day, then check whether the remaining regular hours go over 40 in the week: the same hour is never paid twice as overtime.
How is it calculated?​
Example: a coordinator paid $24 an hour works three 10-hour days and two 6-hour days, for 42 hours. She has 2 hours of overtime on each of the three long days, so 6 hours of overtime and 36 regular hours: $864 + $216 = $1,080.
Example: the same coordinator works 7, 6, 8, 7, 7 and 8 hours, for 43 hours. No day goes over 8 hours, but the week goes over 40 by 3: $960 + $108 = $1,068.
The premium is based on the employee's own regular wage, whatever it is. These two cases follow the department's examples on its overtime page.
Does a general holiday count toward the week?​
Yes. For a pay period that includes a day off for a general holiday, the employee is deemed to have worked the regular hours they would normally have worked that day (section 24). Hours worked on a general holiday are paid at the overtime rate, on top of holiday pay (section 25). Some workplaces, including continuously operating businesses and hospitals, can instead pay those hours at the regular rate and give another paid day off. Can hours be averaged over several weeks?​
Yes, in three ways:
- Agreement without approval (section 11.1): a written agreement, signed at least one week before it starts by the employee or by at least 75% of the group it covers, and posted at the workplace. It covers a period of up to 12 weeks, with no more than 12 hours a day or 60 hours a week, and lasts up to three years. It cannot cover employees who regularly work less than 30 hours a week.
- Collective agreement or permit from the Employment Standards director (section 12).
- Individual flextime arrangement (section 14.1): at the request of a non-unionized employee who works at least 35 hours a week, a written agreement sets other standard hours, up to 10 hours a day and 40 a week. Either party can end it with two weeks' written notice.
In the first two cases, the standard hours for the period equal 40 hours times the number of weeks, or fewer if the agreement provides for fewer.
Who is not covered?​
- employees who perform management functions primarily (section 2(4));
- employees who have substantial control over their hours and earn at least twice the Manitoba industrial average wage (section 2(4));
- members of a regulated profession who practise it, including the health professions governed by The Regulated Health Professions Act (Regulation, section 5);
- volunteer camp counsellors at a residential camp run by a charitable organization (Regulation, section 3.1).

Can overtime be banked?​
Yes, if a collective agreement or a written agreement provides for it (section 18). Each hour of overtime gives at least one and a half hours of time off: 4 hours of overtime give 6 hours in the bank.
The time off is taken during regular hours of work, within three months after the end of the pay period in which the overtime was worked, unless a regulation or the director allows a longer period. It is paid at the regular wage rate at the time it is taken. Any hours left in the bank at the end of that period, or when employment ends, are paid out at the regular wage rate.
Record the pay period each banked hour comes from: that is what starts the three-month clock.
How many sick days are there?​
The Code does not provide paid sick days. After 30 days of employment, an employee can take up to three days of unpaid leave per year for their own health or for family responsibilities (section 59.3). After 90 days of employment, a serious injury or illness gives a right to up to 27 weeks of unpaid leave in a 52-week period, with a physician's certificate (section 59.10).
An employer can only require a sick note if the absence lasts more than one week, or if the employee has already missed more than 10 scheduled workdays because of injury or illness in the calendar year (section 51.2).

How many weeks of vacation do employees get?​

Vacation pay is 2% of the year's wages for each week of vacation (section 39). Those wages exclude overtime wages. Vacation must be given within 10 months after the employee becomes entitled to it (section 35), and vacation pay is due by the last working day before it starts, unless the employee agrees otherwise.
Example: a support worker earned $42,000 in regular wages and $1,500 in overtime wages during his third year. He is entitled to two weeks of vacation and vacation pay of 4% of $42,000, or $1,680.
Each year, flag the employees who reach 5 years of employment: their vacation moves to three weeks and their vacation pay to 6%.
